Shapes Fitness Center in Winnipeg is Evil

On October 4th, 2010 I signed a one year long contract with Shapes Fitness at their location on Nairn Avenue. The contract contained a provision for a one week review period in which you could cancel the contract. I was given the contract to take home and review. After reading the terms on the back of the contract, I decided that I would rather opt for a monthly membership. I discussed this with one of the employees of Shapes the next time I was in their gym and they told me to write a cancellation notice which I did and hand-delivered on October 7th to a gentleman at their Nairn Avenue location.

At the beginning of January of 2006, I attempted to cancel this membership and was informed that I could not as I was signed to a one year contract. I told the person working at the counter that originally I had signed a one year contract but that I cancelled it and opted instead for a monthly agreement, as outlined in my cancellation notice. I was informed that they hadn't received the notice that I hand-delivered and thus couldn't cancel the membership. I told the employee to just do it, and left. My credit card continued being billed, so I contacted Visa and had further charges from them blocked at the end of January.

Everything was fine, until I started getting letters from Citadel Credit of Canada.. I received one letter probably every 2 or 3 weeks in February, March and April. After each letter, I would call the number on the letter. No one would ever answer the phone so I left a series of messages explaining the situation. None of my calls were ever returned and my messages became ruder and ruder as time passed and I received no response. Finally, the letters stopped coming, and I assumed that perhaps they had gotten the message.

A few months down the road, I was doing a routine credit check and noticed an entry from Citadel under the collections section. I contacted them again, and again received no response. I appealed to the credit reporting agency (Equifax), explained the situation to them and asked them to remove the entry on my report, and they refused.

I attempted to get in contact with both Shapes and Citadel. Phone calls to Shapes were unhelpful, everyone just told me “we didn't get your notice”, even though I hand-delivered it. And phone calls to Citadel went unreturned.

Eventually, in July of 2008, I was made aware of my right to appeal to a review board at Shapes, via e-mail. I sent them an e-mail outlining my situation. They responded by denying my appeal and telling me to pay the money. I responded with a sharply worded e-mail.

Following that e-mail, someone actually called me with an offer that if I paid the full amount immediately, they would remove the mark on my credit report and would reactivate my membership for the remaining term. However, I declined this offer because I did not feel I could trust them. I felt that if I paid them the money, then I would have no leverage over them and it would be admitting that I was wrong, and I refuse to reward them for their bad behaviour.

So I called the so-called "consumer protection bureau of Manitoba." They were no help. They 'negotiated so that instead of paying the full amount, I could take $100 off of the cost and they would reactivate my membership (As if I'd go.... would they really want me there anyway?)... ooohhh, wow. So now Shapes is blackmailing me for less money.

F**k Shapes I went there with my buddy and was told about the membership in which there was not even a single word called "contract" that one of the shapes employees explained me a day before I wanted to sign myself in. I went there to sign myself up and they told me about the contract thing. I personally think that they rip people off their money like anything. I understand your situation and feel sorry for you.

  2. I am finding every blog I can post on but Shapes is not just evil they are ridiculous and stupid and I could just go on. So I am about 6 months into my contract...no complaints. My husband gets a job in Gillam and we move. You can't cancel it. Seriously. I said how in the hell am I supposed to work out in Gillam? She said it states it in the contract. Seriously? Anything to get money huh!!!!! What a sham!!!!

  3. Shapes is a scam. I moved from Winnipeg to British Columbia and they have no gym here unless I drive 1.5 hours to get there. I am in a contract, and I moved for a job placement. Shapes is a f*ckin scam and this contract where you can't cancel it for long distance moves is just ridiculous. I hope the government does something about this and I am working on getting this finished. Screw off Shapes!

  4. I signed up for my first gym membership at shapes because I like that they had a women's only section at the time. They were very happy about getting my papers done and even pushing for the fitness trainer. I met with her once and she wasn't even helpful. looking back on the experience she was just showing me some machines on a whim. Afterwards I couldn't schedule her because she had no slots.. then she left and I wasn't substituted or anything. talk about waste of time and money. As this being my first membership the person helping me was telling me that my student membership would end in 6 months and at that time to just stop showing up basically. So that's what I did. I ended finding out they were taking out money for my membership and when I inquired at the front desk. The staff didn't even give me the time basically saying she can't do anything. She just brushed me off. I inquired by email to the headquarters and they were no help either. They couldn't find my existing membership and they had no idea who helped me make my membership.

    I also had a friend who also experienced getting cheated 300 dollars from shapes. She wasn't happy. Neither of us got our money back.

    I've also been told by a former employee of shapes that all they do is pressure the membership even if they have to blurr the lines with their clients. Terrible.

    I will never recommend anyone to Shapes as all they want is your money. There is no customer service. I now go to Goodlife Fitness where the staff are so happy and welcoming. The personal trainer i had when i joined Goodlife actually made a proper schedule and showed me full body workouts, scheduling and diet/supplement tips. I definitely reached my fitness goals there. He even contacted me through mobile to discuss times we could train that would work for my schedule.

  9. I signed a one-year contract with shapes. I was charged an insufficient funds fee for the first month because they incorrectly filled out my banking information and admitted it to being their fault. they refused to compensate me as did headoffice and only offered me a shapes gym bag as compensation. I feel they employ these small scams on a mass scale. $$$

  10. This is laughable, a bunch of people who failed to read the contract properly make a whining blogspot.
    Do any of you actually have evidence that supports your completely delusional and irrational claims. On the contrary, shapes actually has evidence which supports their cause.
    Lesson 1 : always read a contract before signing
    Lesson 2: take responsibility for your faults and pay your bills.

  13. Guys I was wrongfully billed too. Mike has provided a lot of information. I would go to consumer bureau and while they are collecting inform the credit bureau about this. Basically this is a fraud. I would email the cancellation to keep record. In the end these shameless people have to bend over to hard evidence. Always ask for any proof of billing and receipt. Record your conversation with them.

    2. I signed up with shapes too @ McPhillips, Unaware of Non-termination after 7days. As i clearly told their staff that I wanted to try a month Membership as I am going to be a Full-Time student in College this coming Nov. 2. She told me that the only thing that I could do is freeze my account for three months. But in the freezing process, I am not allowed to go use any facility in the gym, giving them my identification card to get inside the building while paying 5 bucks bi-weekly for three months. So I am planning on telling my bank to block any payments from Shapes if I still can't terminate my account sometime next week. It irritated me how she blindly sell me this contract and she told me I can cancel it at anytime.

  17. Please!! Everyone who has been ripped off! Scammed and wrongfully charged money please go to The local RCMP and file a complaint against them, we can all do something about this, then we can put a legal action suit against them, make sure when cancelling your account with them that you ask them for a copy of the cancellation paper you filled out! (Important) because thats your proof that u cancelled the account!!
    They are doing this to everyone, they act like they have done it and then NOPE u are still paying into the contract u cancelled!!
    WORST place to get sucked into! Please make a complaint the more complaints made they will have to look into it and investigate the company and also do something about this!!!
    there scams & so are the workers!! Taught to rip ppl off and ingnorw the claims they make!!! Corrupt company and there BS contracts!!!

    1. Can we actually go to the RCMP about this ? I cancelled my membership they told me my payment ended dec 8th and continued to charge me after and think I owe them one payment but I'm refusing, they claim to say there's no way they can waive it

  18. Go fill out another cancellation, ask for a copy, go to the rcmp and tell them what happened and make them investigate them and the process you went through to cancel! They say they will help shapes but keep records paper trails.. Always keep track on what u filled.

  19. I joined for a 1 year membership. Was told I paid in full and the contract even says this. Then got a frantic call saying that I wasn't but that I could pay the rest later. Last month I go to pay up, told it doesn't say I owe anywhere...then I get an email to pay up, the email doesn't say how much but to call them. I sent them an email to just tell me what I owe and at the very least tell the staff! I go back and told an amount which I pay. Now I got another call to call them, I assume for more money! I hate this place so much. I was lied to and was told my membership included classes. After it was too late to cancel I was told it didn't and I couldn't go to them unless I upgraded. The one who sold me the membership knew full well I was only joining because of the classes. Save yourself the hassle and stress, pay more and go to a quality gym. This place is a freaking nightmare that just never ends...oh ya, and the one who called me can't seem to manage to leave an audible phone number. The closest number I could google was Citadel.

  21. I signed a 1 year contract. And was told I could freeze twice up to 3 months each. So in July I froze my account anND was told I could pay the 35$ after (I never gave them my banking information) do I said okay. Then they reactivated my account and started charging me again. After a month of arguing with them I paid out the rest of my contract and told them to cancel my contract. 8 months later I get a bill saying I owe them (4 months ago my 1 year was up) I Called them and was told that they refrozze my account from Sept to November so my contract isn't up till may. And that I never canceled it. I told them I paid outright and I wasn't giving them another dime. And I didn't sign for the second freeze (never asked for it) they then proceeded to threaten to send me to collections if I do not pay.

    Theyre clocks are never right.

    You might as well bring a tea bag for your water bottle , as their fountains are hot!

    They charge you 25$ for missing a payment then deem you "a delinquent" and dont allow you to workout until the full amount is paid.

    The personal trainers (which are 50$ for 45mins) are never on time!

    I would not recommend this gym to anyone. Its a scam and a trap. I feel betrayed and scammed out of my hard earned money.

    I'm going through the same misery with Shapes. Signed a one year contract. When the year was up (18 months ago) they continued to bill my Visa. I went to the desk and told them that I was finished. I did not want to sign a new contract. The clerk said that that was fine. They continued to charge. In Feb 2016 after being charged for many months, Shapes called me because my credit card had expired and they wanted my new expiry date. I refused to give it to them and again said that on no uncertain terms I was finished and had been finished long ago. They continued to charge my Visa. I phoned to the office and was told by a woman there that I had to quit by letter. It didn't matter that my contract had expired a year before, that my credit card had expired, and that I had gone to the gym and canceled in person. I had to send an e-mail to her personally to get out from under. I sent the e-mail in June. I was still charged. In August I contacted Visa. I canceled the card, sent a copy of the e-mail to them and explained the problem I was having. I had been charged five times after I sent the e-mail. Visa said they would look into it. On next month's Visa bill I had two more charges from Shapes but also a reimbursement of four charges from Visa. So the score was seven charges after the e-mail and repayment of four. I was still down three charges. I contacted Visa to explain the problem. On the last Visa bill I got a repayment of two charges leaving one left. I figured I would quit. Let them have it. But they weren't done with me. I got a call that they wanted my new Visa number. Of course I said no. I was told that the contract said I had to pay for one month after I canceled the contract by e-mail. I said the contract had expired 18 months ago. No good. So, at this time, I'm getting two or three nasty phone calls a day for $30. They already have $15 that I let go but they want their pint of blood. There is no way to get rid of these people and they have no shame at all. My next call is to the police. But be warned! Tell everyone you know to stay very far away from Shapes!

  27. I am having the same problem with Shapes. Four members of family signed a one year contract with Shapes but we moved to a new city after two months. We have been receiving email from Citidel about the crazy amount of money that we have to pay for Shapes (around $8000 in total). If anyone knows how to make this nightmare stops, please help us.   32. My dear daughter signed up...went twice, met fitness trainer, she was completely useless. Jobs changed, could no longer go and they would not do anything for her. She has paid bi-weekly for the past year, she missed one payment, they have taken her to collections. This is insane!!!

  33. What if you guys contact CBC marketplace? I think they investigate things like this. I had a membership when I was 16. Had no idea what I'd signed up for. Wanted to cancel after my parents pointed out that it was a year commitment. They wouldn't let me. Kept paying for a year. This was over about 20 years ago though. Been considering going back, paid the ten bucks for a week trial. I'm concerned about what I signed now but hopeful that nothing can come of it since I didn't give them banking or payment info.

  34. I signed up for a membership with Shapes in September 2016. I had requested an Associate Membership for only the Pembina location and buddy training with my partner at the time. It turns out the consultant signed me up for a basic membership which is twice the price. She had said that the buddy training would be worked into the cost but didn't mention it was spread over the entire contract duration not over the time period recommended for the training sessions, so I thought the higher cost was for a shorter time at the beginning and then the cost would go down once the buddy training sessions were fully paid. Turns out that is not the case so I have been being billed for something that I was not aware of and that I haven't used. Their consultant made the mistake but they don't believe me the customer they say that I had 7 days to find their mistake and correct it or it's my problem, how was I to know there was a mistake when things weren't explained properly and I didn't know there was an issue 7 days into the contract. So not only have they been getting money for services I have not be using but they are also getting money for the buddy training which I can no longer use since my partner and I have parted ways. They wanted me to pay more money to switch my training sessions into solo sessions in order to get use of the money I have already spent, I had suggested that we cut the number left in half and turn them into solo training sessions as that would be fair to everyone but once they came back with a request for more money that was it, I'm done with this company and never going back to their facilities. I have never felt so unappreciated or upset by a company in my life. Not to mention their front desk staff are lackluster to say the very least.

  35. I just got off the phone with 'customer service' with Shapes, and am in tears. I was trying to find the actual policy makers for Shapes, as the fembots at Shapes seem only to know 'that's our policy' as opposed to 'how can i help you'. I am thankful although sad, there are others out there who have also been treated poorly and disrespectfully if their situations god forbid shift. To me this isn't so much the 'contract', its being treated like company first, and customer second. I will never sign up with them again.

  36. Appreciate reading the posts in this forum. Similar situation with a family member. Badly injured back just after becoming member, took many months of slow recovery, then got laid off employment (which was near the gym), now does not travel to that end of the city. Had not used gym membership once, paid over $230 to date of membership fees. Asked to cancel membership, was forced to pay a buyout of over $100.
    NEVER SIGN A MEMBERSHIP! Drop-in rates are $10.50, pay the drop-in rate, or find a gym that won't rip you off if life happens and you can't continue your membership. To everyone on this forum, to make a difference you need to submit your complaint in other places: Better Business Bureau ; MB Consumer Protection Office ; CBC go public ; CBC Marketplace

  38. By the way, complaints to the BBB department don't change. BBB is a money hungry agency and makes sure that their customers which are the businesses have the best ratings and continue to pay their fees. They aren't interested in truly giving a rating that is reflective of the behaviour of a particular business. You can lie, steel, and be unethical and you'll still get an A plus rating from the BBB. The best way to get things to change is to contact the owner directly. Drive up to their house, knock on their door and ask them to stop their actions with respect to destroying your credit rating.

  39. I am on a family plan and had cancelled months ago. They have still continued to take money from the card on file! We tried to contact shapes head office but the woman on the other end would not listen to us and continued to hang up! She basically blocked our numbers so we ended up going to one of the locations to have the manager speak to the head office for us. But the manager ended up being as rude (if not) more rude than the head office person. She clearly had no experience in customer service and dealing with people. Even after we explained everything clearly, the manager said he head officr will "review" our complaint. I told her there was NOTHING to review as our account has been cancelled months prior as well as it is THEFT that they STILL have our banking information on file!

  40. I signed up to go to this gym because it was the closest to my house while I was attending school in Winnipeg for a few months. I signed a 3 month contract with them. I gave the gym my bank account information which is a Copperfin credit union account as I am not from Winnipeg. I am from Kenora ontario, which is why I only wanted a 3 month contract to begin with, and they understood. I let them know I would be moving home in the month of May. ( 3 months after I signed my 3 month contract). The gym tried the bank information and told me that it didn’t go through because it was a “ credit union account “ from Kenora. Therefore I had to start paying them gym with cash as I would attend monthly. After my 3 month conract was up, I told the gym I was finished , which was okayed by the staff at the gym on my last visit. I moved home to Kenora , and it has been almost 5 months since I have attended this gym. I discovered the other day that this gym has been taking money out of my account every two weeks since the month of the month of June. three times in the month of May as well as a random payment of $104. They were taking this money with a name of “PAD” not shaped, so I had no idea what this was. As well as the money I had payed them in cash for the 3 months of attending. Which is ironic since I was told that they didn’t even have my bank information which is why I was paying them cash. They began to take this money without my consent, months later. I called to complain and they have not gave me a refund of almost a thousand dollars .They are telling me that I signed a contract that indicates that after the contracts are up they begin to charge you month to month. This is very criminal. I was completely mislead into believing that they did not have my bank info correct and would not be taking from my account, and they took it months later anyway. I DO NOT recommend this gym! Do not sign any contracts !!!. They’re very unprofessional, and I feel my client trust was violated as they were taking unauthorized payments from my bank account. They were making me pay cash as well as taking from my account that they told me wasn’t working ! I am a very upset customer and they have done absolutely nothing for me and won’t return my phone calls.

  41. Laughable, is all you have?? Did not fail to read my contract. How dare you assume otherwise. Shapes uses very unethical practices and yes buyer beware, but cancelled contract after a year according to their instruction and withdrawal continued out of my bank account until I placed a stop payment (at a cost to me) only to later receive a letter of demand for payment from Citadel. The debt remains on my credit report and have to explain it everytime in financing anything.
